Liability Wavier

This Waiver of Liability and Informed Consent Release (the "Agreement") is entered into by and between the Participant (the "Client") and The Peach Loft LLC, studio located in Elida, Ohio (the "Studio").

1. ACKNOWLEDGMENT OF RISK AND PHYSICAL CONDITION

The Client acknowledges that participation in Pilates or any other physical conditioning program, class, workshop, or private session offered by the Studio involves inherent risks and physical exertion which may be strenuous. The Client understands that such activity may result in physical injury, including but not limited to sprains, strains, fractures, or, in rare cases, more severe injuries, or the aggravation of a pre-existing medical condition.The Client affirms that they are solely responsible for evaluating their own physical and medical condition. The Client warrants that they are in good physical health and do not suffer from any medical condition, physical limitation, or disability that would prevent or limit their full and safe participation in the Studio's activities. The Client agrees to consult with a qualified physician prior to and throughout participation if any concerns regarding physical condition arise.

2. VOLUNTARY PARTICIPATION AND ASSUMPTION OF RISK

The Client certifies that their participation in the activities offered by the Studio is voluntary.

With full knowledge of the possible risks, hazards, and dangers involved, including those known and unknown, foreseeable and unforeseeable, the Client knowingly, voluntarily, and expressly assumes all responsibility for any and all risks, injury, damage, or loss that may result from their participation in any activity or use of the facilities and equipment at The Peach Loft LLC studio.

 

3. WAIVER, RELEASE, AND INDEMNIFICATION

In consideration of being permitted to participate in the programs and services offered by the Studio, the Client hereby agrees to the following:

A. Waiver and Release: The Client, on behalf of themselves, their heirs, assigns, personal representatives, and estate, hereby waives, releases, and forever discharges The Peach Loft LLC studio, its owners, members, directors, officers, instructors, employees, agents, landlords, and affiliates (collectively, the "Released Parties") from any and all claims, demands, damages, rights of action, or causes of action, present or future, whether known or unknown, arising out of or connected with the Client's participation in Studio activities or use of the Studio’s premises or equipment, including any loss or damage to personal property.

B. Indemnification and Hold Harmless: The Client further agrees to indemnify, defend, and hold harmless the Released Parties from any and all liabilities, claims, actions, damages, expenses (including attorneys' fees), or losses brought by the Client, or by any third party, arising from or related to the Client's conduct, actions, or participation while at the Studio facility.

4. MEDIA RELEASE

The Client acknowledges and consents that the Studio, from time to time, may capture photographs, video, or other recordings of classes or events occurring at its premises. The Client hereby grants the Studio the irrevocable right to use the Client's image, likeness, voice, and/or name that may appear in such photographs or recordings for the Studio’s legitimate business purposes, including, but not limited to, marketing, advertising, and promotional materials in any medium (e.g., website, social media, print).

5. APPLICABLE LAW

The Client understands that this Agreement is intended to be as broad and inclusive as permitted by the laws of the State of Ohio. Should any portion of this Agreement be determined by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remainder of the Agreement shall remain in full legal force and effect.
